Drug Paraphernalia legislation (10/06/08)
SAPOL are advising all retailers of items known as water pipes, prohibited pipes and cocaine kits that all such items are now prohibited from sale under the new Drug Paraphernalia legislation and any offering for sale of such items will result in prosecution. The new legislation does not legitimise sale of items that have simply been re-named or modified. In relation to reports in today's media regarding the sale of modified and re-named items referred to as 'Water-Pourer's", SAPOL can advise that as a result of advice provided to that retail outlet by SAPOL, all stocks of 'Water Pourer's" and all other drug paraphernalia have now been removed from sale at that location. Officer in Charge of Drug Investigation Branch, Detective Superintendent Linda Fellows said, "All illicit drugs cause harm to the community and in our view there is no safe way in which to consume illicit drugs. This legislation prohibits the sale of items that are commonly known in the community as being designed for the purpose of consuming illicit drugs, no matter how they may be re-named or modified". Retailers can view the relevant legislation at www.legislation.sa.gov.au under Section 9b of the Summary Offences Act.
