How to loan or borrow a firearm Section 15B of the Firearm Act details the requirements when loaning a firearm to another person. The owner of a class A, B or H firearm may lend a firearm pursuant to a written agreement between the owner and the borrower and that the borrower will only use the firearm for the purpose or purposes specified in the agreement and will return the firearm to the owner within 10 days. A firearm can only be borrowed if at the end of the loan period it can be returned to the owner. The firearm cannot be returned to another person or firearm dealer. The owner of the firearm cannot loan a firearm to another licensed person if the owner's firearm licence has expired. The owner's firearm licence must be current during the loan period. The borrower must have a current firearms licence for the class of firearm being borrowed. What information should be included in the agreement? As a guide for owners and borrowers of firearms the following detail should be included in an agreement to loan a firearm:
NOTE: Owners intending to loan a firearm must view the firearm licence of the borrower and ensure that it is current and for the correct class of firearm being loaned and believe on reasonable grounds that the borrower will not use the firearm for any other purpose that is agreed in the written loan agreement. example: I, David Smith of 10 John Street, Thebarton, firearm licence number 12345F loan my Sportco .22 calibre bolt action rifle, serial number 32453 to John Davies of 25 George Street, Gawler, firearm licence number 543621G for a period of 10 days commencing today 18th April 2011 for the purpose of hunting. 18/4/11 signed by David Smith and John Davies |
