Notification to the Registrar

Notification to the Registrar by Medical Practitioners, Employers or Firearms Clubs

Firearms Act 1977 SA sections 21I(1), s27A(1) and s27A(2) place obligations on:-

  • The Controlling Body of a recognised Firearms Club; or
  • Medical Practitioners; or
  • Registered Nurses; or
  • Registered Psychologists; or
  • Professional Counsellors; or
  • Social Workers; or
  • Employers;

To report to the Registrar of Firearms when they have a reasonable cause to suspect a person is suffering; physical or mental illness or condition or other circumstances; where there is a threat to the person's safety or the safety of another person; associated with the person's possession and/or use of a firearm. The report must be made as soon as possible after the suspicion is formed. This report is to be made on:-

Medical Notification to Registrar of Firearms (PD486A)
Section 27A(1) places an obligation on medical practitioners, registered nurses, registered psychologists, professional counsellors and social workers, who have reasonable cause to suspect a person who they have seen in their professional capacity, is suffering from a physical or mental illness or condition, or other circumstances exist, such that there is a threat to the person's own safety or the safety of another person from the person's possession or use of a firearm; and the person has, or might be intending to acquire, a firearm.  They must make a report to the Registrar of Firearms, as soon as practicable after the suspicion is formed, this report is to be made on a 'Medical Notification to Registrar of Firearms (PD486A) form'.


Employer Notification to Registrar of Firearms (PD486B)
Section 27A(2) places an obligation on employers, who have reasonable cause to suspect an employee, whose work involves the possession or use of a firearm, is suffering from a physical or mental illness or condition, or other circumstances exist, such that there is a threat to the person's own safety or the safety of another person from the person's possession or use of a firearm.  They must make a report to the Registrar of Firearms, as soon practicable after the suspicion is formed, this report is to be made on a 'Employer Notification to Registrar of Firearms (PD486B) form'.

Firearms Club Notification to Registrar of Firearms (PD486C)
Section 21I(1) places an obligation on the controlling bodies of recognised firearms clubs, who have reasonable cause to suspect a person who is a member of the club, is suffering from a physical or mental illness or condition, or other circumstances exist, such that there is a threat to the person's own safety or the safety of another person from the person's possession or use of a firearm.  They must make a report to the Registrar of Firearms, as soon as practicable after the suspicion has been formed, this report is to be made on a 'Firearms Club Notification to Registrar of Firearms (PD486C) form'.

There is no civil or criminal liability where a report is made in good faith, in compliance with the Firearms Act 1977 SA s21I(4) and s27A(4).
